Please read the following Terms of Use applicable to any visitor to the vote.telekom.net & vote2.telekom.net websites, integrations or REST interface (hereinafter referred to as "Application"). By using this website, you impliedly agree to these Terms of Use. The owner of the website reserves the right to change, delete or supplement the information on this website at any time without prior notice.


1. Scope of application

  • a) The following terms and conditions apply to the use of the websites vote.telekom.net, vote2.telekom.net, the integrations or the REST interface (collectively hereinafter: Application). In order to use the Application, it is important that you as a user accept the following terms and conditions.
  • b) By using our Application, you agree to the Terms of Use. By agreeing, you warrant to us that you will not create any posts that violate the Terms of Use.

3. Availability & error

  • a. Vote strives to keep the Service available as much as possible, but as we want to provide an updated and maintained Service, Vote shall always have the right to shut down the Service for service and upgrades without prior notice. The Service shall not be held liable for any downtime or other technical complications.
  • b) We point out:
    • i. that it is technically impossible to provide the Website free of errors of any kind and that Vote therefore assumes no responsibility whatsoever.
    • ii. that errors may lead to the temporary shutdown of the application.
    • iii. that the availability of these web pages is subject to conditions and performance outside the control of Vote, such as transmission capacity.
  • c) We also reserve the right to (i) implement new updates and versions of the Application, and (ii) perform, for example, A/B testing or other actions for improvement, as deemed reasonable and appropriate by us. Vote intends to notify you prior to any updates or maintenance to the Application that result in more than minor interruptions to the Services.
  • d) We will attempt, to the extent possible and commercially reasonable, to correct errors in the Application as soon as circumstances permit. An Error in the Application means a deviation from the description of the current version of the Application and material deviations from generally accepted standards for software that conforms to the Application. Votes' liability for fixing Errors does not include Errors that are not material to your intended use of the Application and do not cause you inconvenience, nor Errors caused by third parties. Applications as noted below.
  • e) Errors in the Application will most likely be resolved by a correction or by providing instructions on how to work around the error. To claim the existence of an Error for which Vote is liable, you must notify us within a reasonable time after discovery of the Error. You must state and, if applicable, show how the Error manifests itself.
  • f) If there is a bug in a third-party application and we cannot fix the bug ourselves, we will report it to the appropriate third-party application provider with the intent to install a fix if we can do so without adversely affecting the application or otherwise negatively impacting Vote. In addition, Vote has no liability for errors in Third Party Applications.
  • g) If we have not fixed a bug with the speed appropriate to the circumstances, you as a user will not be entitled to any economic compensation.

4. Communication

When you use a Vote service or send email, text messages or other communications to us from your computer or mobile device, you are communicating with us electronically. We will communicate with you electronically in a variety of ways, including through email, text messages, or by posting electronic messages or other communications on our Application or as part of other Vote services. For contractual purposes, you agree to receive electronic communications from us and that all consents, notices, disclosures and other communications that we provide to you electronically do not, to that extent, require a writing unless mandatory applicable law requires another form of communication.


5. Copyright & database rights

  • a) All content included in or provided through any Vote service, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations, is the property of Vote or third parties supplying content or making it available on the website and is protected by German copyright and database right laws.
  • b) Also, the entire stock of Content included in or provided through any Vote Service is the exclusive property of Vote and is protected by German copyright and database right laws.
  • c) You may not systematically extract and/or reuse any part of a Service from Vote without our express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract any substantial parts of any Service from Vote for re-use (whether once or many times) without Vote's express written consent. You also may not create and/or publish your own database that includes substantial portions of any Vote Service without Vote's express written consent.

6. Account system & roles

  • a) Vote does not have an explicit account system, which means that no individual user accounts exist.
  • b) In order to provide the creators of Vote objects (hereinafter referred to as objects) with an overview of all their objects, the creator mails are stored centrally and linked to the corresponding objects. If the user wants to remove his mail from the system he can do this at any time, as long as he does not have any running objects anymore.
  • c) By missing the account system, roles (User, Participant, Admin) are set, which each user of Vote can accept for each object via passwords, tokens or also automated.
  • d) Confidential information about Vote objects, such as Vote/Admin passwords, must be kept confidential by the user. You agree to notify Vote immediately if any unauthorized person has obtained knowledge of such information.

7. Personal data

  • a) The protection of personal data is extremely important to us. We collect and use only the personal information we need to provide you with our services in accordance with and for the purposes described in our Privacy Information. The Privacy Information addresses how we collect personal information and what we collect, as well as how the information is used, stored and shared. You will also find information about the processes we use in our services. Please read our Privacy Notice for complete information about how we handle your personal information as well as the cookies we use. We also address how we maintain an appropriate level of security.
  • b) When it comes to Personal Data contained in User Data, Vote is a Processor and you are the Controller. As a Controller, you are solely responsible for the collection, storage, processing and management of such data. personal data in compliance with all data protection laws. Vote will only store data resulting from your use of the Services.
  • c) We do not sell or provide access to any Survey Data or User Data to anyone for any purpose other than solely for the provision of the Services under these Terms.

8. Usage of Vote

  • a) Depending on the module used for the Vote object, the respective group company agreement must be observed in the design and implementation. In concrete terms, these are the KBV Befragungen/Befragungstools or the KBV evaluation in the "Survey" module or the KBV digital collaboration for the "Interactive" and "Quiz" modules. The specific KBV for "Surveys" depends on the content of the actual Vote object and must be determined by the creator and adhered to accordingly.
  • b) Vote is to be used only up to the data protection class "internal".
  • c) Participation in Vote objects is always anonymous and voluntary.
  • d) The creators themselves are responsible for the contents of the Vote objects and their answers.
  • e) You agree not to copy, decompile, decrypt or deconstruct the Application (or any software or code contained in the Application) or reuse such source code. You also agree not to circumvent or attempt to circumvent any security measures of the Application set forth by Vote.
  • f) If you access or use the Services in connection with your employment, you acknowledge that you are authorized to bind your company/employer to these Terms and all references to you contained herein. This applies to both you and your company/employer, if applicable.
  • g) A Vote item is intended to be a business tool. If you are under the age of 16, you must be represented by your parent or guardian to agree to these Terms and use the Application.
  • h) We reserve the right to restrict your access to the Services if you fail to comply with these Terms or if providing the Services could result in more than de minimis harm to Vote or a third party.
  • i) You are responsible for providing Vote with all information necessary to enable us to provide you with the Services set forth herein and our other obligations.
  • j) You must ensure that (i) all User Data and Your Software are free of viruses, Trojan horses, worms or other harmful software code, (ii) User Data and Your Software are in a format suitable for the Application, and (iii) Your Software and/or User Data cannot otherwise harm or adversely affect Vote's systems, websites or Application.
  • k) You agree not to use the Application in any inappropriate or illegal manner and to ensure, such as, but not limited to, posting pornographic, abusive, racist, harassing or otherwise unlawful or inappropriate material in the Surveys or in the creation or by using an alias that reflects any of the above. Vote reserves the right, without warning, to revoke your right to use our Services if you do so. We also reserve the right to (i) investigate and take appropriate action against anyone who violates or is suspected of violating these Terms, including removing any Content at any time and/or reporting it to law enforcement authorities, and (ii) disclose any type of data provided to our Services if we receive a request for information that is required by mandatory applicable laws, government regulations or rules, or by orders of a court or competent authority or arbitration tribunal.
  • l) You are responsible for safeguarding User Data.
  • m) Each vote object requires a creator with an internal Deutsche Telekom GmbH mail address.Therefore, creation is reserved for Deutsche Telekom employees only.
  • n) Before using Vote, each user is required to read through the guide in the relevant areas of the application.
  • o) Furthermore, you may not use the services of Vote for fraudulent or in connection with any crime, unlawful activity, harassment or inconvenience.
  • p) Vote allows the embedding of links on third party sites. However, the User itself is responsible for the embedded links as well as their target websites.

9. Use by external parties

  • a) Externals can assume the roles: User, Participant and Admin of a Vote object. But not the creator role
  • b) If personal data of external persons are entered into the system, the consent of the respective persons must be obtained in advance.
  • c) If external persons actively enter personal data into the system themselves, the conditions for use (point 8) apply.

10. Confidentiality

Both we and you hereby agree to keep confidential and not disclose to any third party any confidential information or data received from the other party. Confidential information is any information whether technical, commercial or otherwise, whether documented or not. However, such information may be disclosed if such disclosure is necessary to enable a party or its employees to (i) defend against litigation, (ii) file and prosecute patent applications, (iii) comply with laws and governmental regulations or orders of any court or competent authority or arbitral tribunal, or (iv) comply with applicable stock exchange rules or the rules of any other recognized marketplace. Confidentiality under this provision shall not apply to information that (i) is publicly available; (ii) becomes publicly known through no fault of the receiving party; (iii) was known prior to its disclosure by the receiving party, as evidenced by written records; (iv) is disclosed in accordance with these Terms or with the prior written consent of the other party; or (v) is disclosed to the receiving party by a third party having a lawful right to such disclosure.


11. Liability

  • a) Vote shall be relieved from performing its obligations to you under the Terms if performance thereof is prevented or delayed by any cause beyond Vote's control, such as, but not limited to, civil commotion, fire, flood, natural disaster, war, accident, act of terrorism, sabotage, strike, embargo or other governmental action. We will promptly notify you in the event of any such force majeure event and provide you with relevant information Information thereon.
  • b) We will always endeavor to ensure that Vote's services are available without interruption and that transmissions are error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to Vote's services may occasionally be interrupted or limited to allow for repairs, maintenance or the introduction of new facilities. We will attempt to limit the frequency and duration of any such temporary interruptions or limitations.
  • c) You are liable for the Vote Objects you create and are responsible for all User Data and other data you submit to our Services.
  • d) Vote shall never be liable for any indirect, incidental or consequential damages, including, but not limited to, loss of profits, data or revenue, arising out of or in connection with these Terms or your use.
  • e) Vote will not be liable for any loss, damage or expense arising from: (i) User Data or other content and information submitted by you and your audience when using our Services; (ii) errors, nonconformities, and poor performance of your software, hardware, or Internet connection; (ii) corruption or destruction of data or other damage caused by viruses related to your computer system(s), hardware, software, or other devices; (iii) Errors that occurred as a result of (a) downtime or other technical complications (other than what is expressly set forth in Section 3 (Application Errors)) or (b) any of the reasons set forth in Section 6 (Service Availability, Maintenance, Testing and Downtime) and/or Section 8 (Force Majeure); (iv) Errors caused by any modification or disruption of the Application by you or a third party or by any other circumstances for which you or a third party are liable or otherwise beyond Vote's control; and/or (v) the loss, destruction, unavailability, alteration or disclosure of User Data caused by you or a third party, although if caused by a third party, we will, of course, use commercially reasonable efforts to recover the lost or damaged User Data from the most recent backups maintained by us.
  • f) You agree to indemnify and hold Vote harmless for all damages, costs and expenses caused by (i) your breach of the Terms of Service, (ii) User Data or other content and information submitted by you and your audience when using our Services, and (iii) that you violate any applicable law or infringe the rights of any third party.
  • g) To the extent that Vote's liability is excluded or limited, this also applies to the personal liability of employees, representatives and agents.

12. Modification of the conditions

We may change these Terms at any time for a variety of reasons, including to reflect changes in applicable law or updates to the Services and to reflect new services or features. The most current version is always available to view through the means set forth above, so be sure to review the Terms in effect at the time of your use. Changes will take effect no earlier than the date they are posted on our website. In order for certain changes to become effective, applicable law may require that we obtain your consent to those changes or provide you with reasonable advance notice. If you do not want to agree to the changes to these Terms, you should stop using the Services, because by continuing to use the Services, you accept to be bound by the updated Terms.


13. Final provisions

  • a) Contract language is German
  • b) If you violate these Terms of Service and we do nothing about it, we are still entitled to exercise our rights on any other occasion in which you violate these Terms of Service.
  • c) We reserve the right to make changes to our website, rules and regulations, terms and conditions, including these Terms of Use, at any time. If any provision of these Terms of Use is invalid, void, or for any reason unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
  • d) The invalidity of any provision shall not affect the validity of any other provision under the Agreement. Should this occur, the provision shall be replaced according to its meaning and purpose by another legally permissible provision that corresponds to the meaning and purpose of the invalid provision.
